 TERMS AND CONDITIONS   

 

General

  • On booking (deposit paid) the holidaymaker agrees to this legally binding contract between the property owners Florence Bennett & Ben Thorpe and the holidaymaker. The property owner is also referred to as "we" and "us".

  • The holidaymaker is the person who makes the deposit payment. This person is responsible for ensuring all members of the holiday party accept and adhere to these terms and conditions. The holidaymaker is also referred to as "you".

  • The terms apply to E10 Broadview and E35 Hawkes Point View, Riviere Towans Chalet Camp, Phillack, Hayle, Cornwall TR27 5AT, United Kingdom.​

Bookings

  • We take bookings from persons over 18 years of age. We reserve the right, without giving reasons, to refuse a booking.                                                                       

  • Payments are made by bank transfer and acknowledged by email on receipt.  

  • A 25% deposit is required at the time of booking over 30 days away, and the balance due 30 days before arrival. For bookings less than 30 days away, the payment will need to be made in full.

 

Cancellation by the Holidaymaker

We understand that sometimes things don't go quite to plan, if you do need to cancel your stay below are our cancellation terms. We do strongly encourage you to take out your own travel cancellation insurance:

  • If cancelled more than 30 days before your stay we will always try to resell the dates for a refund. If we are unsuccessful, I am afraid, we will keep your deposit. It may be possible to move dates completely at our discretion, with plenty of notice, otherwise standard cancellation policy will apply. 

  • If cancelled 30 days or less from your stay- 100% of your booking cost will be retained unless we are able to resell your dates, in which case we can offer you a refund, but this may be less if we have had to secure a a re-sale by using a  ‘special offer’ at a discounted rate and we have the right to charge an admin fee for reselling these dates. 

  • We reserve the right to refuse any booking or cancel any bookings subject to refunding any sums you have paid without further liability on our behalf.

  • We cannot accept responsibility or pay any compensation where the provision of the holiday is prevented or affected by reason of circumstances that amount to “force majeure”. These include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of the property through fire, flood, explosion, storm or other weather damage, break-in, criminal damage, riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity, epidemic, pandemic and all similar situations beyond our control. We strongly advise guests to take out holiday cancellation insurance in advance of their trip.

  • Where possible, we will try to help you change the date of your booking if you can no longer make it, however this is entirely at the discretion of our Customer Support team and if they cannot make a change, then the standard cancellation policy will apply. All date changes must be requested more than 4 weeks in advance of the original booking, otherwise standard cancellation policy will apply.

 

Cancellation by the Property Owner

  • The property owner will endeavour to make sure the stated property is available for the dates contracted. In the unlikely event the property becomes not available and the property owner has to cancel the booking, the property owner will endeavour to assist the holidaymaker to find suitable alternative accommodation. The holidaymaker shall be entitled to a full refund. The property owner shall only be liable to return the monies received. No compensation or consequential losses shall be paid.

 

Miscellaneous

  • Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things do change. The holidaymaker accepts that no refunds are available for such discrepancies.

  • The property owner reserves the right to enter the property, at a reasonable time, in the event of an emergency or remedial repair work being required.

  • The property owner is entitled to ask the holidaymaker to leave the property without any refund if, in the property owner's opinion, the behaviour of the holidaymaker and/or his/her party is unacceptable.

  • The property owner reserves the right to refuse entry to anyone, who in the property owner's opinion is not suitable to or capable of taking charge of the property.

  • The property owner reserves the right to ask the holidaymaker and their party to leave the property, without refund, should the behaviour of the holidaymaker and/or their party be considered by the property owner to be unreasonable.

 

Occupancy

  • The maximum number of people entitled to stay at Broadview is 4 and Hawkes Point View is 5. If it is found that more people than agreed are using the property, this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without any refund. Sub-letting of the property is prohibited. 

  • Unfortunately, pets are not allowed in the cabins unless previously discussed with us. 

 

Arrival and Departure Time

  • Every effort will be made to have the property available from 15:00 ( Broadview) 16:00 (Hawkes Point View) on the day of arrival. The property must be vacated by 10:00 ( Broadview ) 11:00 ( Hawkes Point View) on the day of departure. Late departure will result in an additional charge being made. 

 

Liability

  • The property owner takes no responsibility for the personal possessions of the holiday maker or the holidaymaker's party. Vehicles and possessions are left entirely at the risk of the holidaymaker. We shall have no liability for any death or personal injury unless this results from our negligence.

 

Damages / Breakages & Cleaning

  • The holiday maker should make every effort to keep the property, fixtures and fittings and all contents in the same state of repair and condition as at the start of the holiday. 

  • We do not take a breakage deposit, but we have the right to charge for breakages and damages. We expect a degree of wear and tear, but if damage is directly attributable to the guest, then we reserve the right to invoice for payment.

  • If the accommodation unit is not left in an acceptable condition, and Cove Valley has to carry out extra cleaning above and beyond what they would normally expect £50 will be charged.

 

Complaints

  • Every endeavour is made to ensure your stay with us is memorable for all the right reasons. However, we do recognise that from time to time things do go wrong. In these circumstances, it is the responsibility of the holidaymaker to make any such problem known to the property owner (or their representative) immediately it becomes apparent, thereby giving the property owner the opportunity to correct the situation. Unless this procedure is followed, no subsequent claim will be entertained.

  • The property owner will make every endeavour to rectify any identified problems as soon as is reasonably possible.

 

Onsite regulations 

  • Disposable barbecues or fire pits are not allowed to be used on site due to the risk of fire. 

  • Please do not feed the seagulls

  • Please dispose of your waste at the site points, recycling where possible, do not leave bags outside or beside the bins, as they will be picked apart by seagulls. 

  • Please drive carefully, there are likely to be wild children! 

 

No smoking policy

  • The cabins are NO SMOKING PROPERTIES. Smoking is strictly prohibited inside the cabins. Failure to comply will result in an additional fee of £400 to cover deep cleaning and re-decoration. Any guests smoking outside of the cabins are responsible for disposing of their cigarette buts in a bin and must not litter the surrounding area.

 

Personal Details

  • In order to process the booking, we will need certain information from the guest about the party. It may be used for administration purposes solely by us and for sending the guest future promotional or marketing literature. Any information will remain confidential and is protected under the Data Protection Act 1988. 

 

Law

  • The contract between the guest and us is governed by English Law. Any dispute the guest has with us shall be dealt with in an English Court of Law.
